1. What We Offer

Motion Fun develops and distributes extensions and templates for Adobe After Effects and Adobe Illustrator. Some tools are free; others require a paid license. The site also offers email newsletters about tool updates and creative topics.

2. Free Tools & Templates

Our free tools (such as Anchored, Noted, and Picky) and free After Effects templates are provided at no cost. You may use them for both personal and commercial work. You may not redistribute the tools or templates themselves. Share the download link instead.

3. Premium Tools & Licensing

Premium tools (such as Petals) require a paid license purchased through our payment provider, Polar.sh. Upon purchase:

• You receive a personal license to use the tool for your own work, including commercial projects.
• The license is tied to the email address used at checkout.
• You may install the tool on your own machines for your own use.
• You may not share, resell, sublicense, or redistribute the tool or your license credentials.
• You may not reverse-engineer, decompile, or modify the tool's source code.

4. Payments & Refunds

Payments for premium tools are processed by Polar.sh. Pricing is displayed on the product page at the time of purchase and may change without notice (existing purchases are not affected).

If you experience a technical issue that prevents you from using a purchased tool and we cannot resolve it, contact us at hey@davey.design and we will work with you on a resolution, which may include a refund at our discretion.

5. Acceptable Use

You agree not to:

• Use our tools or site in any way that violates applicable laws.
• Attempt to interfere with, disrupt, or overload our infrastructure.
• Scrape, crawl, or programmatically access the site beyond normal browsing without permission.
• Misrepresent your identity or affiliation when purchasing or contacting us.

6. Intellectual Property

All tools, templates, site content, branding, and code are owned by Motion Fun (Davey Design). Purchasing a tool grants you a license to use it. It does not transfer ownership of the software or its intellectual property.

Work you create using our tools is yours. We make no claim to any content you produce with our extensions or templates.

7. Third-Party Dependencies

Our tools run inside Adobe After Effects, Adobe Illustrator, and similar host applications. We are not affiliated with Adobe. Compatibility with host applications depends on their versions and updates, which are outside our control.

8. Disclaimer of Warranties

Our tools and templates are provided "as is" and "as available." We do our best to keep everything working, but we make no warranties, express or implied, regarding reliability, accuracy, fitness for a particular purpose, or uninterrupted availability. Use at your own discretion.

9. Limitation of Liability

To the fullest extent permitted by law, Motion Fun and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of (or inability to use) our tools, site, or services. Our total liability for any claim related to our products or services is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to our services if you violate these terms. For premium tools, we may revoke a license if it is being shared or redistributed in violation of Section 3. If we terminate your access without cause, we will provide a pro-rated refund for any affected purchase.

11. Changes to These Terms

We may update these terms from time to time. When we do, we will revise the "last updated" date above. For material changes that affect your rights, we will make reasonable efforts to notify you. Continued use of our site or tools after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes arising under these terms will be resolved in accordance with applicable U.S. law.
